		<description>I think another reason is one of vicarious guilt.  Since everyone (or the vast majority) has at one time or another had an illegal compilation tape or downloaded that one song that they can't find anywhere, or the one song that they enjoy from the otherwise poor album, considerable empathy is created for the accused.

I speculate that since people feel some guilt on their own, they tend to be lenient with anyone accused except in the most egregious cases.

This is not a unique phenomenon.  We do it with drunk drivers too.  I know a lot of people who have driven after having "one too many" at some point in their past.  I think when faced with someone else who as done the same thing you get the same leniency, again in all but the most egregious cases.

Just my thoughts.
